Privacy Notice for California Residents

This privacy notice supplements the information contained in the Privacy Policy of LendingHome Corporation and its subsidiaries (collectively, "LendingHome" "we," "us," or "our") and applies solely to visitors or users who reside in the State of California ("consumers" or "you"). We adopt this notice to comply with the California Consumer Privacy Act of 2018 ("CCPA") and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

 

Information We Collect, Use, and Share

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("Personal information").

Personal information we receive from you reflecting a communication or transaction between us and another business when you are acting as an employee, owner, director, officer, or contractor of such company, partnership, sole proprietorship, nonprofit, or government agency and you are seeking a product or service from us for the company, partnership, sole proprietorship, nonprofit, or government agency is designated as "Business Consumer Personal Information".

Personal information does not include:

  • Publicly available information from government records
  • De-identified or aggregated consumer information
  • Information excluded from the CCPA's scope, like:
    • Personal information covered by other Federal or California privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

You, or, with your permission, third parties, your browser, computer, or mobile device, public records, service providers such as data providers, consumer reporting agencies. Make a credit decision on your loan, to facilitate purchase and sale of real estate property. Service providers related to the customer transaction, data analytics companies, real estate related companies, fix and flip companies, Purchasers/Investors of mortgage loans, cloud services providers, law enforcement agencies, Marketing and advertising providers.
Internet/network activity.

(Examples: browsing history, search history, and interaction with our website)

You and your browser, computer, or mobile device; service providers and partners such as marketing and data providers; and third parties such as advertisers and analytics providers. Provide, improve, and resolve errors in our Services; prevent fraud and ensure the security of our Services; provide and improve advertising, and products offered. Service providers such as analytics, diagnostic, cloud, customer service, advertising and marketing providers, law enforcement as required by law, and third party partners such as those offering real estate related products.
Geolocation data.

You and your browser, computer, or mobile device (if you grant us access to it). Adhere to state/federal regulations; provide and improve our Services. Service providers related to the customer transaction, law enforcement as required by law, cloud services providers, and customer experience analytics providers.
Inferences from other PI

You and your browser, computer, or mobile device; service providers and partners such as marketing and data providers; and third parties such as advertisers and analytics providers. Provide and improve advertising, and products offered. Advertising and marketing providers, data analytics and customer experience providers, cloud services provider.

 

Sharing Personal Information

We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

 

 

Your Rights and Choices

California residents can exercise the following specific rights under the CCPA regarding their personal information. Please note that these rights do not apply to Business Consumer Personal Information as defined above.

 

 

Opt-out of sales

We may sell your Personal Information to a third party for a business or commercial purpose. California law broadly defines "sale". As such, our use of these services may constitute a "sale" (as defined by California law) of the following categories of information to advertising partners for such advertising purposes: identifiers such as IP address, device IDs, cookie IDs, and advertising IDs. You have the right to direct us not to "sell" your personal information by making a request as detailed below.

 

 

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months including: the categories of personal information we collected about you, categories of sources for the personal information we collected about you, our business or commercial purpose for collecting or selling that personal information,the categories of third parties with whom we share personal information, the specific pieces of personal information we collected about you, and if we sold or disclosed your personal information for a business purpose: the personal information categories that each category of recipient purchased or personal information categories that each category of recipient obtained.

 

 

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, or take actions reasonably anticipated within the context of our ongoing business relationship with you.
  • Detect security incidents, protect or prosecute against fraudulent, or illegal activity, or debug products.
  • Comply with the California Electronic Communications Privacy Act or any other legal obligation.
  • For internal uses that are reasonably aligned with your expectations or other internal and lawful uses.

 

 

Exercising Sales Opt-Out, Access, Data Portability, and Deletion Right

To exercise the opt out, access, data portability, and deletion rights described above, please submit a verifiable consumer request to us through one of the following methods:

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. Your verifiable consumer request must provide sufficient information that allows us to reasonably verify you or an authorized representative.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

 

 

How we Verify your Sales Opt-Out, Access, Data Portability, and Deletion Rights Requests

Password-Protected Accounts: If you have a password-protected account with us, we may verify your identity through our existing authentication practices for your account. We may require you to validate two or up to three data points (request to know specific pieces of information requires three data points). Non-Account Holders: If you do not hold a password-protected account with us, we will require you to validate two or up to three data points (request to know specific pieces of information requires three data points).

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

 

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights.

 

 

Changes to Our Privacy Notice

We are required by law to update this California Privacy Statement at least once each year. This California Privacy Statement was last updated on March 24, 2021.
